1. Acceptance of Terms

By creating an Averoz account, generating a website, or otherwise using any part of the platform, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy and Refund Policy, which are incorporated here by reference. If you do not agree, please do not use the service.

If you use Averoz on behalf of a company or organization, you represent that you are authorized to accept these Terms on its behalf, and “you” refers to that entity.

In these Terms, “Averoz”, “we”, “us”, and “our” refer to PT Digital Wijaya Group, the Indonesian limited liability company that owns and operates the Averoz platform. PT Digital Wijaya Group is registered at Jl. Kyai Mojo No. 25, Kelurahan Semanggi, Kecamatan Pasar Kliwon, Kota Surakarta, Jawa Tengah 57191, Indonesia, under Business Identification Number (NIB) 1604260060856, and is the party that contracts with you, provides the service, and is responsible for billing and refunds.

2. Description of Service

Averoz is an AI website builder. You describe your business in a guided chat, our AI generates a structured website design, and our engine renders it into a real, editable website that you can publish online.

• The first Home Preview is generated for free and costs 0 credits.
• Developing the full website and making AI-powered edits consume credits, while manual content editing is free.
• Published websites include managed hosting and a free SSL certificate, served from Averoz infrastructure (VPS and CDN).

We may add, change, or remove features over time to improve the platform. We will not materially reduce the core functionality of a paid plan during its active billing period without reasonable notice.

3. Accounts & Eligibility

To use Averoz you must create an account and provide accurate, current, and complete information, including a valid email address and (where required) a verified WhatsApp number. You are responsible for keeping your details up to date.

• You must be at least 18 years old, or have the legal capacity to enter a contract.
• You are responsible for safeguarding your login credentials and for all activity that occurs under your account.
• Each account has one responsible person or entity. Notify us promptly at support@averoz.com if you suspect unauthorized access.

4. Credits & How They Work

Credits are the unit Averoz uses to meter AI usage. We use the English term “credit / credits” throughout the platform.

• The first Home Preview is free (0 credits).
• Credits are only deducted when an action completes successfully. If an AI action fails or is cancelled, you are not charged. Manual editing is always free.
• Paid plans include a monthly credit allowance that replenishes at the start of each billing period. Unused plan-allowance credits expire at the end of that period and do not roll over.
• You may buy one-time top-up credits at any time. Top-up credits are added to your balance and used after your plan allowance, subject to the Refund Policy. Top-up credits do not expire and remain valid for as long as your account is active and the Service is available.

5. Plans, Billing & Renewals

Averoz offers Free, Starter, Pro, and Business plans, billed monthly or yearly. Paid plans renew automatically at the end of each billing period until you cancel.

• Payments are processed through Xendit (in Indonesian Rupiah, for Indonesia) and PayPal (in US Dollars, for international customers). The available currency is determined automatically by your locale.
• Prices are shown before checkout, inclusive of stated amounts, with no hidden fees. Applicable taxes may be added where required by law.
• Upgrades take effect immediately; downgrades and cancellations take effect at the start of the next billing cycle, so you keep access to your current plan until it ends.
• You can cancel auto-renewal at any time from your dashboard.

6. Coupons & Promotions

From time to time we may offer coupons or promotional codes. Each coupon is subject to its stated validity period and expiry, is single-use unless stated otherwise, has no cash value, and is non-transferable. We may withdraw, suspend, or void a coupon at any time in the event of abuse, fraud, or error. A purchase made entirely free through a 100% coupon involves no payment.

7. Refunds

Payments are generally non-refundable except as described in our Refund Policy, which forms part of these Terms. Please review it for details on subscriptions, credit top-ups, and add-on services such as domains.

8. Acceptable Use

You agree not to use Averoz to create, publish, or distribute content that:

• is illegal, fraudulent, defamatory, or infringes the rights of others;
• contains malware, phishing, or is designed to deceive or harm visitors;
• is hateful, harassing, sexually exploitative, or otherwise harmful;
• misuses or abuses the AI, automated systems, or platform resources;
• resells, sublicenses, or copies the platform itself in violation of these Terms.

You are solely responsible for the legality and accuracy of the content you create and publish through Averoz.

9. Intellectual Property

You own the content and data you provide, and the website content generated for you belongs to you. You grant Averoz a limited license to host, store, process, and display that content as necessary to operate the service.

Averoz owns the platform, software, templates, design system, and underlying technology. We grant you a non-exclusive, non-transferable right to use the platform during your subscription. You may not copy, reverse-engineer, or resell the platform itself.

10. Hosting, Domains & Availability

Published sites are static-first and served with managed hosting and free SSL from Averoz infrastructure. Custom domains are supported depending on your plan, and you may also purchase a domain through Averoz as a reseller.

• Domain registration fees are paid to the registrar and are separate from your Averoz subscription; they follow the registrar’s own terms and renewal cycles.
• If your plan or hosting is not renewed, your published site may be temporarily deactivated. Your data and content are retained for a reasonable period so you can renew or export, after which they may be removed.
• We aim for high availability but do not guarantee uninterrupted service. Maintenance and unforeseen events may cause downtime.

11. Third-Party Services

Averoz relies on third-party providers, including payment processors (Xendit, PayPal), AI providers (such as Anthropic Claude and others), and infrastructure and notification partners. We work to integrate them reliably, but we are not responsible for their outages, errors, or actions. Your use of those services may also be subject to their own terms.

12. Disclaimers & Limitation of Liability

The service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee any specific business result, ranking, traffic, or revenue from a website built with Averoz.

To the maximum extent permitted by law, Averoz is not liable for indirect, incidental, or consequential damages. Our total liability for any claim is limited to the amount you paid to Averoz in the three (3) months before the event giving rise to the claim.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under the laws of the Republic of Indonesia, including the Consumer Protection Law (UU Perlindungan Konsumen, UU No. 8 of 1999) and the Personal Data Protection Law (UU Pelindungan Data Pribadi, UU No. 27 of 2022). Your statutory rights as a consumer remain unaffected by these Terms.

13. Suspension & Termination

We may suspend or terminate your account if you breach these Terms, fail to pay, or use the service in a way that harms Averoz, other users, or third parties. Where reasonable, we will give you notice and an opportunity to resolve the issue.

You may stop using Averoz and close your account at any time. On termination, your right to use the platform ends and your published sites may be deactivated, subject to the data retention described above.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, notify you. Continuing to use Averoz after changes take effect means you accept the updated Terms.

15. Governing Law & Contact

These Terms constitute an agreement between you and PT Digital Wijaya Group, and are governed by the laws of the Republic of Indonesia, without regard to its conflict-of-law rules. In the event of any dispute arising out of or relating to these Terms or the service, the parties will first seek to resolve it amicably through good-faith negotiation. If the dispute cannot be resolved within a reasonable period, it will be submitted to the District Court (Pengadilan Negeri) of Surakarta, Indonesia, unless otherwise required by applicable consumer law.
